Firecrackers prohibit in Delhi: Plea in High Court seeks urgent hearing

NEW DELHI: On Friday, a petition was filed in the Delhi High Court, asking for an urgent hearing on the Delhi government's decision to prohibit the sale and use of firecrackers in the national capital ahead of Diwali. Advocate Gautam Jha brought the case before Chief Justice D.N. Patel's bench and requested an urgent hearing because Diwali is approaching. Because the main counsel was not present on Thursday, the case was adjourned until December 13.

"We are not allowing or declining. Give the case number in detail; we'll look at it later in the day "According to the Chief Justice. The court had previously taken note of the respondent's claim that the related matter had already been examined by the Supreme Court. Rahul Sawariya and Tanveer, represented by Advocates Gautam Jha, Pankaj Kumar, and Shweta Jha, asked the respondent to consider Graded Regulations rather than a complete ban on firecrackers during the Diwali festival.

"The decision to prohibit all types of firecrackers prior to Diwali for about 1.5 months is arbitrary and unreasonable," the petition claimed. It was also claimed that banning the use of firecrackers one and a half months before Diwali was excessive.

The petition reads:  "The Respondent's action must be no more intrusive than is necessary to achieve a significant public goal." Although the petitioner acknowledges that Article 25 of the Constitution is subject to Article 21, the extent of the Respondent's interference by its decision/order is not proportionate to the ultimate goal and objective of reducing pollution in the NCT of Delhi, the petitioner contends that the extent of the Respondent's interference by its decision/order is not proportionate to the ultimate goal and objective of reducing pollution in the NCT of Delhi.
