High Court of Madras orders restoration of community certificate for woman

Chennai: The Madras High Court has ruled that a Dalit's Scheduled Caste certificate cannot be revoked by going to church and hanging a cross symbol of Christians. The high court has termed the administrative officers who passed such an order citing the Constitution as "WICKED-minded". The petition was filed by P Muniswari who is a doctor by profession. In fact, in 2013, the DM of Ramanathapuram district of Tamil Nadu revoked the certificate SC of the woman doctor stating that the woman had converted to Christianity on the basis of which she was not eligible for scheduled caste certificate of the Hindu community.

The administrative authorities based their decision on the findings of the woman doctor's visit to the clinic and the subsequent investigation, in which, according to them, a 'cross' was found hanging on the clinic wall. According to media reports, the decision of the district's administrative authorities was challenged by P Muniswari in 2016 while filing a petition in the court, which, according to the first bench of Madras High Court Chief Justice Sanjeev Banerjee and Justice M Duraiswamy, the Scheduled Caste Certificate of a woman who married a Christian youth and recognized her children in her husband's religion was a Scheduled Caste certificate of administrative officers Cannot be cancelled on the basis of weak facts and arguments given.

Questioning the affidavit filed by the administrative authorities, the High Court said that the authorities have not been able to prove whether the woman doctor has abolished her faith in Hinduism or converted to Christianity. According to the court, if a person goes to church for some reason, it does not mean that he has lost his faith in his original religion.
