Govt cracks down on Chinese shell Firms; mastermind detained

On September 8, the Ministry of Corporate Affairs carried out simultaneous searches and seizures at the locations of Jillian Consultants India Pvt Ltd, a wholly-owned subsidiary of Jillian Hong Kong Ltd with offices in Gurugram, Bangalore's Fininty Pvt Ltd, and Hyderabad's Husys Consulting Ltd. The Serious Fraud Investigation Office (SFIO) on Sunday arrested one Mr Dortse and a Chinese national, who is on the board of Jillian India, and are believed to be the masterminds of the racket.

The scheme involved setting up numerous shell firms in the nation with connections to China and placing fictitious directors on their boards. According to documents kept by the Registrar of Companies, Mr. Dortse had demonstrated that Mandi, Himachal Pradesh, was his residence (ROC).

The ROC Delhi found during its investigation that dummy directors were paid to operate by Jillian India in several shell companies. The MCA stated that boxes filled with company seals and digital signatures of dummy directors were recovered from the site.

The Indian staff were conversing with the Chinese counterparts through a Chinese instant messaging service. Husys was also discovered to be acting on behalf of Jillian India Ltd.

The MCA stated that investigations have revealed the possible involvement of shell companies in “serious financial crimes detrimental to the financial security of the country”.

The ministry has assigned the investigation of Jillian, and 32 other companies to SFIO that operates under the aegis of MCA. The investigation found that Mr Dortse fled from Delhi NCR to a remote plane in Bihar, and was attempting to escape from the country through road.

When the suspect was detained on September 10 in a remote location, a special SFIO team was sent there.
The investigation further revealed that Dortse had fled from Delhi NCR to a remote area in the state of Bihar and was attempting to flee India via the road route, according to information received and the investigations conducted.

Immediately, a special team was constituted in SFIO which was deputed to the said remote place, MCA said adding that on the evening of 10th September 2022, SFIO had arrested Dortse, who was later produced in the Jurisdictional Court and Orders for his transit remand were obtained.
