GST return on filing may lead to freeze bank account or cancellation of registration

Non-filing of GST Return is now overshadowing businessmen. According to reports, the bank account of those who do not file GST returns may freeze or their registration can be canceled. In the case of non-filing of GST returns, the Finance Ministry has made it a part of the Standard Operating Procedure (SOP). Taxpayers may be required to file GST returns either monthly (in case of general supplier) or quarterly (in case of supplier opting for composition scheme).

Media reports said that about 20% do not file GST assess returns. Due to this, the revenue of the government is affected. The Central Board of Indirect Taxes and Customs (CBIC) has prepared a Standard Operating Procedure (SOP) to deal with defaulters in GST payments. If GST is not paid on the due date, a system generated notice will be sent to the defaulters. If payment of the outstanding amount of GST is not cleared within 5 days, then notice under Form 3-A will be sent. Payment will be mandatory within 15 days after this notice.

If GST is not paid within 15 days, an officer will calculate the tax liability of the person concerned. The officer can then seek recovery of returns after issuing the Form GST ASMT-13. If payment is not made within the time limit given under section 29 of the CGST Act, then the officer can proceed to cancel the registration. Through section 83 of the CGST Act, the commissioner can temporarily confiscate so that there is no loss of revenue. This Act clarifies that registration cannot be canceled without giving the GST taxpayer an opportunity to be heard.
