SC rules floor test will be live, rejects Cong-JD(S) plea over pro tem speaker

Hearing on Congress-JD(S) plea challenging the appointment of pro tem speaker KG Bopaiah, began in the Supreme Court over Karnataka Politics today.

SC said in its rule 'Law can't direct the Governor to appoint a particular person as Pro-tem Speaker. Unless convention becomes legal norm, it can't be enforced by Court'.

Additional Solicitor General Tushar Mehta, appearing for the Governor, told Supreme Court that live recording of floor test would ensure transparency, to which the Supreme Court said that let all channels be given access to broadcast the floor test live.

On the arguments from Congress, Kapil Sibal said 'The individual appointed must be the senior most member of the House which is a convention in the Parliament also.'

Kapil Sibal added, 'Long standing convention has been broken after the appointment of Bopaiah', adding that 'Even SC has ratified this practice in two judgments'.

In Plea challenging appointment of pro tem speaker, Justice SA Bobde said 'There've been instances where senior most MLA wasn't appointed as Pro tem speaker after which Kapil Sibal replied 'KG Bopaiah has different history. His decision of disqualification was set aside by this Court earlier.'

Abhishek Manu Singhvi and Kapil Sibal to appear for Congress & JD(S), Sr Advocate Ram Jethmalani also present; AG KK Venugopal and ASG Tushar Mehta along with Sr Advocate Mukul Rohatgi  to defend appointment of Pro tem speaker, Karnataka.
