High Court Kerala stays cheating case against Sunny Leone

KOCHI: The Kerala High Court on Wednesday stayed a cheating case lodged against actor Sunny Leone (Karanjit Kaur Vohra) and her husband Daniel Weber.

In response to a petition submitted by the couple and their employee, the court halted all further proceedings in the case. The complainant said that Leone did not attend at events despite being paid lakhs of rupees to do so.
A case was subsequently filed against the couple on the grounds that they had committed offences covered by Indian Penal Code Sections 406 (criminal breach of trust), 420 (cheating and dishonesty inducing delivery of property), and 34 (acts done by multiple people in furtherance of common intention).

In addition, they pointed out that the complainant had filed a civil lawsuit with identical claims, which a magistrate court dismissed in July 2022 for a lack of proof. They, therefore, attempted to halt the actions taken against them.
The trio had requested anticipatory bail in February 2021, and single-judge Justice Ashok Menon had given them temporary protection from arrest.

The petitioners' claims that the claimed offence against them is exclusively civil in character would also be supported by the complainant's filing of a civil suit before the 3rd Additional Sub Court, Ernakulam, the court has also been informed in the plea.

Also, the petitioners claim that they gave the organisers adequate time to transfer the funds and even agreed to frequent date and venue changes out of a sense of corporate camaraderie, all of which resulted in significant difficulties and financial losses for the petitioners.
