Mumbai: A Pocso court in Mumbai has left the 28-year-old accused saying that "holding a minor's hand and expressing love for him cannot be considered sexual assault.'' In fact, the accused was arrested in 2017 after proposing to a 17-year-old girl and has now been released. In the case, the court said in the hearing, "There is no evidence to prove that the accused intended to commit sexual abuse.''
Not only that, while pronouncing the verdict, the court also said that there was no evidence to indicate that the accused constantly chased the victim, stopped her in a deserted place, or used criminal force to sexually abuse a minor. According to a report on a well-known website, the judge while pronouncing the verdict said, "The prosecution failed to bring evidence that the accused tried to sexually assault him. Therefore, the accused is acquitted giving the benefit of the doubt.''
Let us also tell all of you that this is not the first time that the court has refused to treat holding a child's hand as a sexual offense. In fact, the court has done so before. In fact, the Bombay High Court had earlier overturned the sentence of a 50-year-old man for allegedly molesting a five-year-old girl. At that time, the court had ruled that it was not in the definition of sexual abuse to hold the hand of a minor by unbuttoning his pants.
