Kolkata: Now the name of the current education minister of the state, Bratya Basu, has also been linked to the teacher recruitment scam case of West Bengal. Bengal Education Secretary Manish Jain on Friday (November 25) claimed before a single bench of Justice Abhijit Gangopadhyay that at the behest of Education Minister Bratya Basu, additional posts of teachers were being created for those whose jobs have been dismissed due to illegal engagement. The High Court lashed out at the state government and TMC for this.

According to the report, in response to the question of Justice Abhijit Gangopadhyay, Manish Jain has said that the decisions to create additional vacant posts were taken in the cabinet meeting. After that, the order was given from above to create the post. Education Minister Bratya Basu had given instructions in this regard. A discussion was also held with the Advocate General of the province, the concerned advocates, and the chairman of the School Service Commission regarding the creation of additional posts. Expressing surprise, Justice Abhijit Gangopadhyay said that lawyers are also giving the advice to re-appoint those appointed illegally. He asked whether any decision has been taken to sack those who have been appointed illegally. 

In response to this, the Education Secretary told the court that at present discussions are going on in this regard with the Law Department. Manish Jain has told the court that this decision was taken in the cabinet meeting, not by me. After this, the Justice said, give a copy of the decision of the cabinet, how can the state cabinet take the decision to retain those who became teachers without taking the exam or without passing the bribe?

The judge further said that to date, has it ever happened that the cabinet has taken a decision to save the jobs of unqualified people or those appointed illegally? What kind of governance is this? I do not understand how any cabinet can decide to save the jobs of illegal people. This is absolutely against the Indian Constitution. This is a very serious issue, not only for Bengal, but it is a matter of concern for the whole country. If the democratic process does not remain in the hands of the right person, then its development is not possible. The Justice further said that the copy of the Cabinet decision would be preserved with the Registrar of the High Court. At present, he has not given a verdict on this matter, at present, the hearing is going on.
