New Delhi: The Supreme Court has asked the Central government the reason for earmarking an annual income of Rs 8 lakh for the economically weaker sections (EWS). The court told the central government that you cannot say that it is a matter of policy. The Supreme Court said that after all, how can the income norm be applied equally across the country? A three-judge bench headed by Justice DY Chandrachud asked ASG KM Nataraj, representing the Central government, what practice did you practice to fix criteria of Rs 8 lakh? Or did you accept the criteria that apply to OBC?

The court said the income norms cannot be applied equally across the country as the annual income of people from big metros like Mumbai and Bengaluru cannot be compared with the people of a remote village in Uttar Pradesh. Even if their income is the same. The Supreme Court raised the question while hearing petitions filed by Neil Orelio Noons and others. These challenge the notification issued by the Central Government on July 29 to introduce OBC and EWS quota in all India quotas from this academic session in postgraduate courses in medical colleges across the country.

Out of the candidates selected through NEET, 15 per cent of seats in MBBS in medical colleges and 50 per cent in MS and MD courses are filled with all India quotas. On the other hand, ASG Nataraj argued that implementing reservation is a matter of policy. On this, the court asked what practice you practised to reach the Rs 8 lakh mark or did only what was applicable to OBC. Referring to the Indra Sahni (Mandal case) verdict, the court said that those earning less than Rs 8 lakh meet the criteria of educational and social backwardness and economic backwardness. Here we are facing pure economic backwardness. We want to know what the Centre has practised.
