New Delhi: If you are suffering from a serious illness and go to a hospital or clinic for treatment, it is Doctor's duty to treat you with full care. If the doctor refuses to treat you, then he can be land into legal trouble as the Fundamental Right under Section 21 of the Constitution includes the right to seek treatment.

In the case of Parmanand Katara vs Union of India, the Supreme Court had held that no doctor or hospital can refuse to treat a seriously injured patient. It is the legal duty of the doctor and the hospital to provide emergency medical care to a patient suffering from serious injury or serious illness. Nor will the treatment refuse.

The first priority of the doctor should be to treat the patient immediately so as to save the patient's life. Also, under the Professional Conduct Regulations of the Indian Medical Council, the doctor will have to treat the patient. If he refuses to treat a patient, it will be considered professional misconduct and action can be taken against him.
