Modi govt giving citizenship to persecuted minorities of 3 countries including Pak, Muslim League reached SC

New Delhi: The Indian Union Muslim League (IUML) has filed a petition in the Supreme court challenging the Central government's decision to grant Indian citizenship to non-Muslim minorities in three neighbouring countries. The petition challenged a notification allowing minorities from Pakistan, Afghanistan, Bangladesh to apply for citizenship.

The Muslim League has appealed to the Supreme Court to stay the notification. It was IUML who first challenged the Citizenship Amendment Act (CAA), 2019 in the Supreme Court. The notification, issued by the Ministry of Home Affairs on May 28, empowers non-Muslim minorities from Afghanistan, Pakistan and Bangladesh living in 13 districts of Gujarat, Rajasthan, Chhattisgarh, Punjab and Haryana to apply for Citizenship of India. Earlier in 2016, 16 district magistrates of the country were directed to accept applications for citizenship under the Citizenship Act, 1955.

the IUML has filed an application in the pending CAA case challenging the May 28 notification on the ground that the provisions of the Citizenship Act do not allow classification of applicants on the basis of religion. Section 5(1) (A) (G) of the Citizenship Act allows eligible people to apply for citizenship by registration, while Section 6 of the Act allows any person (except illegal migrant) to apply for citizenship through naturalization.
