The company of Tokyo, Emonster, is a trademark of 'animoji' in the US. The company has filed a lawsuit against Apple for using its feature in the iPhone X. Emonster is the owner of the iOS app called 'Animoji', which gives people the ability to send emoji, which animates like a GIF in a loop.

IPhone X's 'Animoji' feature features Apple's face detection technology 'Face ID' to help people turn their face photos into emoji on the go. In a lawsuit filed in the U.S. Federal Court, Emonster said that Apple has deliberately tried to use its name.

Media reports have stated that in this case, the allegation that the animoji app and the iPhone X feature are both on the Apple platform and both are related to the animations, so the court has decided to remove any one. According to the petition, Apple was aware of Emonster trademark because this app is only available on Apple's store.

Emonster said in the complaint, “Apple decided to take the name and pretend to the world that ‘Animoji’ was original to Apple.” Emonster said it is seeking unspecified money damages and a court order blocking Apple from using the term while the lawsuit is pending.

Investors see the iPhone X, which will sell for $999, as an opportunity for Apple to refresh a smartphone lineup that had lagged the competition in new features.  The iPhone X has wireless charging, an infrared camera and hardware for facial recognition, which replaces the fingerprint sensor for unlocking the phone.
