ISRO spy case: Nambi Narayanan gets big relief from Kerala High Court

The Kerala High Court on Monday dismissed a petition filed by a former police officer who wrongly implicated former ISRO scientist Nambi Narayanan in a 1994 espionage case. The petition alleged that Nambi Narayanan has influenced the investigation of the CBI in the case registered against him. Former Kerala Police officer S Vijayan has alleged that Nambi Narayanan influenced the agency's action by making land deals worth crores of rupees with the then CBI investigating officers.

While it has been found that Justice R Narayan Pisharadi has rejected S Vijayan's plea. Detailed instructions awaited. Vijayan and 17 other former Kerala police and EB officials are still under investigation for CBI in 1994 for allegedly falsely implicating Nambi Narayanan and some others. Vijayan argued before the high court that he has placed before the trial court the encumbrance certificates of several acres of land in Tirunelveli district of Tamil Nadu, which stated Nambi Narayanan or his son as the holders of the power of attorney.

He alleged that these lands were sold to CBI officials and argued that the material was sufficient to direct a trial court inquiry under the Prevention of Corruption Act against the scientist and the agency's officials. However, the High Court has said that the debt certificates do not prove the sale of land and has made many points to show Vijayan the actual sale deed. The high court also said that the lower court would also need permission to prosecute to order an inquiry.
