BENGALURU: A special bench of the Karnataka High Court denied all petitions seeking permission to wear hijab in classrooms on Tuesday.

"Wearing of the hijab is not an essential part of Islam," the HC added. The requirement of a uniform is constitutional, and pupils have no right to object." The decision was read aloud by Chief Justice Ritu Raj Awasthi.

"We are of the considered opinion that the wearing of a headscarf by Muslim women is not a fundamental element of Islamic faith practise." The requirement of school uniforms is just a reasonable restriction that is constitutionally permitted and to which the kids have no objection, according to the decision.

"In light of the foregoing, we are of the considered conclusion that the government has the authority to issue the government order of February 5, 2022 (restricting hijab in classrooms) and that no argument is presented for its invalidation," the bench stated. "We are of the considered conclusion that no case is made out for the issuance of direction of disciplinary action and warrants against the respondents," the bench continued. As a result, the petition in this case is dismissed as unmaintainable.

"In light of the foregoing, all of these petitions are without merit and liable to be dismissed, and all pending applications are not maintainable and disposed of," the bench stated. After starting the session, the bench stated that it had formulated a few questions and that they had been answered, taking a holistic view of the entire situation.
