Kerala govt tables University Laws Bill to replace Governor as Chancellor of varsities

Thiruvananthapuram: The government of Kerala on Wednesday tabled the University Laws (Amendment) Bill, 2022 in the State Assembly to replace the Governor from the post of chancellor in the universities of Kerala.

P Rajeev, the minister of law for Kerala, presented the bill before the assembly. The bill change was opposed by opposition leaders because they said it violated Supreme Court rulings and University Grants Commission (UGC) regulations. When this legislation become law and enter into force, there won't be any more financial strain on the State's consolidated coffers, contrary to what the opposition claimed in regard to the Finance Memorandum.

The opposition's objections to the measure have primarily been political in nature, said the Law Minister P Rajeev, who responded in the parliament.

"One argument made was that UGC norms should remain if they conflict with state legislation. You have made an extremely risky political declaration. Where does Congress, the political party, stand on this, is my query.

 According to Article 254, in the event of a conflict between a law produced by the legislative assembly and legislation established by the Parliament, the law made by the Parliament shall have precedence in the concurrent list. What exactly is subordinate law? It is law that has been passed by a body other than a legislature.

If Congress is adopting this stand, any issue under the concurrent list, any law passed by the assembly can be modified and amended by the Central Government. Are you with that? Is the Opposition saying Chief Minister Pinarayi Vijayan should be the Chancellor?" he said.
