K’tka High Court orders Rs.17.66-La. compensation to man who lost genitals in road accident

Bengaluru: The Karnataka High Court has promulgated an order granting of Rs 17.66 lakh compensation to a man who lost his genitals in a road accident resulting him permanently incapable of leading a normal marital life.

Basavaraju, the petitioner, was involved in an accident 11 years ago in Ranibennur, Haveri district, and his genitals were permanently damaged. A division bench of the Karnataka High Court issued the ruling after hearing his compensation claim.

The Motor Accident Claims Tribunal had previously awarded the victim only Rs 50,000 in compensation and directed the insurance company to pay the victim Rs 3.73 lakh in total compensation, including additional claims. Because of the petitioner's loss, the High Court enhanced the sum to Rs 10 lakh and ordered the insurance company to pay him a total of Rs 17.68 lakh in compensation.

Despite the fact that the petitioner had requested a total compensation of Rs 11.75 lakh, the bench decided to award him a higher amount in recognition of his plight.

In 2011, Basavaraju was strolling along the street when he was hit from behind by a truck. After carefully considering all circumstances of the case, the court concluded that the petitioner has lost the opportunity to marry as a result of the accident. Money will never be able to make up for his loss.
