In a historic decision, the Madras High Court has acknowledged the invaluable contributions of housewives and granted them equal rights to their husband's property. Justice Krishnan Ramaswamy emphasized that housewives dedicate themselves tirelessly to the welfare of their families, warranting fair entitlement to half of their husband's assets. The court further recognized the inherent value of a housewife's 24-hour labor.
The court affirmed that the housewife possesses an equal claim to the property acquired through her husband's personal finances. It noted that the husband's accumulation of substantial wealth would not have been possible without the unwavering support of his wife, who diligently managed the family's affairs.
Regardless of whether the property is registered under the husband's or wife's name, the court emphasized that the monetary assets were generated through the joint efforts of both spouses.
The court's pronouncement came in response to a petition filed by the children contesting their mother's entitlement to half of their father's property. Previously, the husband, who had been employed in the Gulf, had accused his wife of infidelity upon his return. He also alleged that she recklessly squandered his property. Following his demise, the sons carried on the legal battle.
