Law Commission Calls for New Input on the Uniform Civil Code

NEW DELHI: The 22nd Law Commission of India has recently requested fresh input from a variety of stakeholders, including the general public and religious organizations, regarding the Uniform Civil Code (UCC).

The previous 21st Law Commission had already examined this matter and sought opinions from stakeholders through its appeal. In August 2018, the previous commission had also released a consultation paper titled "Reforms of Family Law."

According to a statement by the commission, they have received an overwhelming response since the issuance of the consultation paper more than three years ago. Considering the significance and relevance of the subject, as well as various court orders pertaining to it, the 22nd Law Commission deemed it necessary to re-evaluate the matter.

It is worth mentioning that in August 2018, the 21st Law Commission, led by former Supreme Court judge Justice B.S. Chauhan, stated that the UCC was not necessary or desirable at that stage in the country. In a 185-page consultation paper, the commission emphasized that secularism should not undermine the country's existing diversity. It stated, "Preserving cultural diversity is essential, and striving for uniformity should not jeopardize the nation's territorial integrity."

The commission further asserted that a unified nation does not necessarily require complete uniformity, and efforts should be made to reconcile diversity with universal and undisputed human rights. In a robust democracy, differences do not always indicate discrimination, according to the government's top legal advisory body. Nevertheless, the commission suggested that certain aspects of marriage and divorce should be uniformly accepted across personal laws of all religions.
