Court sentences youth to one year jail for winking at minor and giving flying kiss

Mumbai:  A 20-year-old youth has been sentenced to one year in jail by a special court on charges of lynching a minor and giving a flying kiss. Let all of you know that the youth has been in jail since March. In the order that has been given at the moment, the court has said that 'The period of sentence of the youth should be assumed to have started from March'. Apart from this, the court has also said that 'If all the evidence record is seen, it was a sexual gesture. So it is sexual harassment of the victim.

On 29 February 2020, the 14-year-old victim had told her mother that the accused has sexually assaulted the minor several times, that is, she has been beaten and given a flying kiss a number of times. After all this, the victim's mother filed a case under Section 354 and Poxo Act at LT Marg police station. During the trial, the victim, her mother, and the investigating officer were investigated. Now the court has said in the order that the youth is convicted on the basis of the statements.

In this case, the convict said in the court that 'he is being implicated in a false case'. During this time the convict has also told that there was a condition between the victim's cousin and her and that is why she did so. Apart from this, the convict also said that the victim's mother also used to refuse to talk to him, because they are from different communities. At the same time, the court has said in its order that the guilty party did not bring anything in the record to prove that the case is false.

Apart from this, the court said that the accused also failed to prove that the charges of the POCSO Act were leveled against him for any purpose. Further, the court also said that 'If the convict was 19 years old at the time of the incident, then he can be given concession. Considering the nature of the crime, some leniency may be shown to give the accused an opportunity to live a good life'.
