Judge exempting rape accused saying, ' Boy belongs to good house'

NEW YORK: A judge's decision in the New Jersey rape case has sparked controversy. In 2017, a boy was accused of raping a minor girl during a house party. According to court documents, the 16-year-old accused made a video of the rape and allegedly shared the video with his friends. The video continued to be shared for months even after the girl urged several times. According to the documents, the boy texted his friends: 'When  its your firts time rape.'

The accused pleaded for trial as an adult instead of Juvenile against the accused by making several arguments. However, in July 2018, a family court rejected the request and the court of appeal has now expressed displeasure over the reasoning given by the judge. Monmouth Superior Court Judge James Troano said the boy's actions cannot necessarily be called rape because traditional rape cases involve two or more men and tortured someone with weapons and guns.

The judge said the boy cannot be prosecuted as an adult because he belongs to a good family that has put him in the best school. He was from Eagle Scout, his always good numbers in the exam have been coming and he was moving to a good college admission. The judge said the girl and her family should have thoughtfully charged the boy because it could have a very bad effect on his life. However, on June 14, the New Jersey Superior Court's Appeals Division overturned the judge's decision and returned to the bench for hearing the case.
