Mumbai: A special court of the National Investigation Agency (NIA) in Mumbai has turned down the bail pleas of the three accused while hearing a case relating to links of the Elgar Parishad in Pune, Maharashtra, to Naxals. The court in its judgement clearly said that it is clear from the facts that the three had conspired with the Communist Party of India (Maoist) to create unrest in the country and assassinate Prime Minister Narendra Modi.

Special Judge DE Kothalikar of the NIA court refused to grant bail to Sagar Gorkhe, Ramesh Gaichor and Jyoti Jagtap. A letter submitted to the court stated that the CPI(M) wanted to end the 'Modi govt' in any case. In order to fulfil their nefarious designs, they were in the process of targeting PM Modi's roadshow and committing another such incident as the assassination of former PM Rajiv Gandhi. In a detailed order issued on Thursday (February 17, 2022), the court said, "The letters and documents placed on record prima facie indicate that the applicants, in connivance with the people of the banned organisation, had hatched a serious conspiracy to create unrest in the entire country and to remove the government from power politically."

The court said it was clear from the records that the three accused Sagar Gorkhe, Ramesh Gaichoor and Jyoti Pratap were not only members of the CPM, but were also involved in the acts which are nothing but the overthrow of the country's democracy. The three accused were associated with Kabir Kala Manch. The court also said that if these allegations are taken into account, it becomes clear that these people have acted with the intention of risking or potentially endangering the unity, integrity, security and sovereignty of the country. The jailed petitioners were actively involved in the conference of the Elgar Parishad in Pune and the three were arrested in September 2020, since then they have been in jail.
