The Center and the Tihar Jail Administration had filed a petition in the Delhi High Court against this decision. After a special hearing on Sunday, the High Court reserved its decision. Nirbhaya's parents appealed to the Delhi High Court to take a decision on the petition soon.

The High Court dismissed the petition of the Center challenging the trial court's stay order. But, the court also said, "There is no doubt that the convicts have resorted to delays by using delays.
