According to the release note from OnePlus, users participating in the open beta program will be the first to receive the upgrade. However, users who haven't signed up for the open beta program are also getting the update rolled out on their devices, as per the OnePlus forum.

OnePlus 9 and OnePlus 9 Pro users in India who participated in the open beta program will soon be able to download the OTA update. The update will not be immediately available to other users. To check for the update manually, go to Settings > System > System update.

Additionally, for users in North America, OnePlus is providing an option to roll back to the Open Beta Program version of OxygenOS 13. The Chinese smartphone maker is allowing users in India and North America to downgrade to Oxygen OS 12, which is based on Android 12, if they wish to.
