New Delhi: The privileges given to members of Parliament in India's democracy compel them to perform their duties properly. If any member violates or misuses privileges or rights, it is considered a violation of the Privileges Motion. The proposal applies to members of the Lok Sabha and Rajya Sabha of parliament. Under parliamentary laws, the breach of privilege motion is punishable.

Their main function is to keep the government accountable within Parliament. There is no distinction between the PM and other members of Parliament in the eyes of the Chairman within the House.

According to Section 105 of the Constitution, violation of privilege is investigated, while in the case of the state legislature, in accord with Article 194, the resolution is passed. According to the rules, the notice should be related to the recent incident. It also requires the intervention of the House. After the speaker's consent, members can question the motion for breach of privilege or contempt of the House.

Why are these proposals being brought?

In fact, the proposal has been mentioned due to a statement by the Central government that 'not a single death due to lack of oxygen.' The Congress and the Aam Aadmi Party (AAP) are preparing to bring a breach of privilege motion. On Tuesday, the Health Ministry had told the Upper House that states had not reported any deaths due to oxygen shortage during the second wave. The exercise of bringing a privilege motion on the same written statement is underway.
