A group of ministers led by the deputy chief minister of Haryana, Dushyant Chautala, has been set up by the GST Council to recommend any legal amendments necessary to establish the GST Appellate Tribunal (GSTAT).
Last week, the GST Council, presided by Finance Minister Nirmala Sitharaman, decided to form a Group of Ministers (GoM) to resolve a number of issues that the states had with the formation of the GSTAT.
According to the GoM's Terms of Reference (ToR), the panel would suggest any necessary adjustments to the GST statute to make sure that the legal requirements preserve the proper federal balance and are consistent with the general goal of uniform taxes throughout the nation.
The six-member GoM would also guarantee that the revisions complied with different court rulings pertaining to the tribunal's establishment.
In order to develop its recommendations, the GoM will engage with legal professionals. By July 31st, the GoM will present a report to the Council.
Along with Chautala, other members of the GoM include the ministers of finance for Andhra Pradesh, Mauvin Godinho for Goa, Shanti Kumar Dhariwal for Rajasthan, Suresh Khanna for Uttar Pradesh, and Niranjan Pujari for Odisha.
The Group of Ministers is expected to address the concerns of states in light of the Madras High Court order which mentioned that the number of technical members should not go beyong the number of judicial members in GSTAT.
