Woman living in live-in relationship seeks right to pension in Madras HIGH Court

Chennai: A different kind of case has come to light in the Madras High Court, which has surprised everyone. A woman has filed a petition here seeking the right to retirement and pension benefits of a person living in a live-in after his death. A single bench of the Madras High Court has referred the matter to a larger bench for a verdict.

In fact, Sushila, wife of S Kaliaperumal, who works at Tamil Nadu Electricity Generation and Distribution Corporation (TinzCO) in Kumbakonam, Tamil Nadu, had cancer, allowing her sister Malarakodi to marry her husband. Also the three of them were living with their three sons and three daughters. After marrying Sushila, Kaliaperumal had declared Sushila as his nominee in the official document. After his wife Sushila died, she applied with the consent of her children to declare Malarkodi as her nominee. Meanwhile, The department has not yet taken a decision after Kaliaperumal died before the document was improved. Malarkodi has filed a writ for pension benefits.

Justice S Vaidyanathan, who is currently hearing the case, has referred the matter to a larger bench for final verdict. With this, the matter will now be heard before the Chief Justice of the High Court and a bench will be constituted.
