NEW DELHI: A lower court in Delhi has also held it an offence to have a consensual relationship with a minor. The court has convicted two accused in the rape case after befriending a 15-year-old minor girl. The court said there is no justification for the consent of the minor for sexual relations. So both the accused are accused of raping a minor girl.

Additional Sessions Judge Umed Singh Grewal has sentenced both the accused Parvesh Rana (30) and Ashish Sehrawat (41) to jail. The judge said there was no justification for the minor's consent to have a physical relationship. It is a crime to have a sexual relationship with a minor girl by befriending her, whether he has the consent of the girl or not.

According to Section 375 of the IPC, a girl under 16 years of age has a consensual sex rape. The court observed that relations with the prosecutor were formed with his consent. According to the report of Rohini and Tihar Jail Superintendent, the accused Parvesh Rana Bitey has been serving a jail term for more than six years and Ashish has been in jail for about five and a half years.
The court said that the accused have to maintain their family and have already been sentenced to several years in jail. In view of these facts, the court sentenced him to a jail term equivalent to the time he had spent in jail. The court also imposed a fine of 40 thousand rupees on Rana and 60 thousand rupees on Sehrawat. 80 % of this money has been ordered to be paid as compensation to the victim.
