'Drug taker should not be punished,' petition filed in SC in defence of Aryan

New Delhi: The Narcotic Drugs and Psychotropic Substances NDPS Act has been challenged in the Supreme Court. Some sections of the Act have been challenged while filing a petition in the apex court. The petition also said that there should be a legal difference between drug traffickers, peddlers and consumers. The petition seeks to do away with the provision of punishment for drug takers.

The petition has been filed by advocate Jaikrishna Singh and he has challenged sections 27A, 35, 37 and 54 of the NDPC Act. He has said in his petition that there should be a legal difference between drug traffickers, peddlers and consumers. He says that traffickers and peddlers must be punished, but they should remove the consumer from the sections of crime, sympathetically. They have demanded an end to the provision of punishment to the consumer. He has said in the petition that a provision should be made to send the drug users to rehabilitation centres as drug victims.

In his petition, Jayakrishna Singh said that due process is not being followed with Aryan based on the same Act. He said that while drug users have been excluded from the category of crime all over the world, it is a crime under the NDPS Act in the country. He has termed it as the biggest anomaly.
