Muslim women cannot marry another man without taking divorce from first: Punjab and Haryana HC

Chandigarh: The Punjab and Haryana High Court has given a big decision on divorce and marriage of Muslim women and men. The High Court has clarified that Muslim women cannot get a second marriage without getting divorced, but Muslim men are allowed to have a second marriage without divorce. A Muslim man can marry more than one marriage without divorcing his first wife. But this rule does not apply to Muslim women.

The High Court has said that if a Muslim woman is to perform a second marriage, she must first divorce from her current husband according to the Muslim Marriage Act 1939 (Dissolution of Muslim Marriages Act, 1939) or Muslim Personal Law. This decision has been pronounced by High Court Judge Alka Sarin. In fact, a Muslim loving couple from Nuh, Mewat, Haryana, had sought protection from the court, on which the verdict was given.

They said the loving couple told the court that they were already married. The Muslim woman alleged that she was married against her will, so now she is going to marry her lover. On this, the High Court said that since the woman has not taken the divers from her husband before marriage with her lover, she cannot be given protection as a couple, as it is not legally valid to demand protection on the basis of marriage is.
