NEW DELHI: Union Law Minister Ravi Shankar Prasad has suggested early bail for undertrials. According to him, the undertrial women prisoners who have spent a quarter of the maximum sentence on charges against them should be released immediately. Referring to Section 436-A of the CRPC, the Law Minister said, "I have to give some specific suggestions on the provisions of bail for undertrials.

According to this section, if an undertrial prisoner has spent half of the maximum sentence prescribed for his offences in jail, he must be released on bail. It also provides that the Review Committees headed by District Judges will look into cases where undertrial prisoners have been in jail for a long time. Ravi Shankar Prasad said that the review committee needs to work more effectively.

This provision needs to be implemented in a more effective manner. He said, in 50 per cent of the cases, the accused spend the entire period of imprisonment as undertrial in jail. He also expressed concern about a number of pending criminal appeals and stressed the need for speedy trial of cases pending for 10 years or more. Law Minister Prasad was saying all this while addressing judges and lawyers on the sidelines of the inauguration of the 17th All India Meeting of the State Legal Services Authority.
