Schools cannot prevent student's TC even if fees are outstanding- Delhi High Court

New Delhi: The Delhi High Court has ruled that schools cannot withhold a student's Transfer Certificate (TC) in case fees are outstanding. Justice D. N. A bench headed by Patel passed the order on Thursday taking cognizance of a letter. The letter mentions the case of Karthik and Priyanka. In fact, his current school in the national capital Delhi had refused to issue transfer certificates due to a fee arrears of about Rs 1 lakh, which led to him not being able to enter another school.

After converting the letter into a PUBLIC Litigation, the court ordered the private school to issue transfer certificates to the parents of nine-year-old Karthik (class three) and five-year-old Priyanka (pre-primary) within a week. Advocate Ashok Agarwal, appointed as a court friend for the co-operation of the court, argued that under Rule 167 of the Delhi School Education Act, 1973, a school can remove the name of the student from its register on arrears of fees, but making it an issue and transferring the student. I can't stop the letter.

After the hearing is over, the court has held that under the Delhi School Education Act, a private school has no right to stop the TC of the student for non-payment of outstanding fees.
