Mumbai: The Maharashtra government is considering an important decision related to the investigation of the Central Bureau of Investigation (CBI) in the state. According to sources, the Eknath Shinde government may soon lift the ban on the CBI investigation in the state. However, nothing has been said about it officially yet. Prior to the Shinde government, the Maha Vikas Aghadi government had banned the CBI, for which the central agency needed to get the approval of the state government's home department to start the investigation. Sources said the new government is expected to lift the ban soon in a cabinet meeting. Maharashtra is one of the many states that withdrew the general consent to conduct CBI in their territory. 

Similarly, when general consent is withdrawn, the CBI needs to obtain case-wise consent for investigation from the concerned state government. If specific consent is not given, CBI officers will not have the power of policemen to enter that state. In October 2020, the Maha Vikas Aghadi government of Maharashtra withdrew the permission given to the CBI to investigate in the state. Although this did not make any difference to the cases involved in the investigation, but if the CBI wants to investigate any new case in Maharashtra, then it will need to take permission from the state government, unless the orders of the court have been given.

It is not the same that the entry of the CBI was banned only in Maharashtra, till November 2020, along with Maharashtra, in the states of Mizoram, West Bengal, Rajasthan, Chhattisgarh, Kerala and Jharkhand, the CBI has to take permission from the state government before investigation. Among these states, only Mizoram is a state that is included in the BJP government.
