Supreme Court allows interim quota in SC/ST employees' promotion

NEW DELHI: The Supreme Court (SC)  of India today allowed the Centre to endow with reservation in promotion for SC/ST employee as per law in anticipation of the issue doesn’t pass judgment by its Constitution bench. At the same time, the SC didn't make clear which law to pursue.

The Centre asserted the bench that it was abide by to give promotion to its employees, and that promotion has virtually come to a standstill after orders passed by different high courts.

"I'm govt and I have to give promotion to my employee," said Additional Solicitor General Maninder Singh to the SC as quoted by TOI.

Then the SC noted that the promotion can be proceeded with as per 'a law'.

"We can say that you can go ahead with promotion as per law and we won't mention what is (the) law," said the Apex court.

In April, Union minister and BJP collaborator Ram Vilas Paswan, who has emerged as the government's key representative on Dalit issues, told reporters that the government will move the top court for the revoke of its orders which, he added, have cut short the reservation for these communities in promotion.

His declaration comes close on the heels of the government's pronouncement to file pleas in the Supreme Court in opposition to its two orders which, it has argued, would function against the interests of the SCs and the STs.
