SC questions "How many generations will reservation continue?"

Mumbai: The country's largest court, while hearing the Maratha reservation case on Friday, said how many generations of reservations will continue in jobs and education. The Apex Court also expressed concern over the disparity arising out of the removal of the ceiling of 50% in the reservation.

A five-judge bench led by Justice Ashok Bhushan categorically told the lawyer Mukul Rohatgi, who was lobbying on behalf of the Maharashtra government in the case, that the Mandal's decision to abolish the quota needs to be revisited in the changed conditions. Meanwhile, Maharashtra government lawyer Mukul Rohatgi told the court that the responsibility of fixing reservation quota in changed circumstances should be left to the States and the decision on the Mandal case was based on the 1931 census. He said the apex Court's decision in the Mandal case needs to be reconsidered in the changed circumstances on fixing the quota limit.

The next hearing in the case will be on Monday. On Thursday, Attorney General KK Venugopal had told the Supreme Court that the 102 amendments to the Constitution do not deprive state legislatures of making laws determining socially and educationally backward classes (SEBC) and provide benefits for them.
