During the hearing on encroachment by hotel and resort owners in Kasauli, Himachal Pradesh, the Supreme Court asked the state government to not flatter the government. In fact, advocate Abhinav Mukherjee, appearing for the government, said that the wife of a judge of the Supreme Court has put a public interest petition in the High Court, therefore the Supreme Court should not hear the matter.

A three-member bench chaired by Justice Madan B Lokur told the state government, "Do not become a spokesperson for vested interests. You are a lawyer, as well as a court officer. Do not become the flatterer of the state government.

Earlier, the state government counsel said that the wife of Justice Deepak Gupta filed a PIL in the Himachal Pradesh High Court. Therefore, the bench should not hear the petition. It is known that Justice Deepak Gupta is also part of the bench hearing.

On the lawyer's objection, the bench asked to the lawyer if he has read the PIL. The bench said that the PIL was linked to encroachment on forest land. After this, the bench asked the state government to file a status report within two months on the instructions related to the defection of encroachments committed by the hotel and resort owners in Kasauli.  It is known that a hotel owner who came to compliance with encroachment order was shot dead by a hotel owner. In this case the Supreme Court automatically took cognizance.
