Supreme court's verdict, 'Permission of state government mandatory for CBI investigation'

New Delhi: Questions have often been raised about the jurisdiction of the Central Bureau of Investigation (CBI) investigation. The question that often arises is whether the CBI will need to get permission from the states concerned for the investigation. The top court has given a big decision in this case. Now it will be mandatory to get approval from the concerned state for CBI investigation.

In a judgment, the country's largest court on Thursday confirmed this and said that this provision is in accordance with the federal character of the Constitution. The apex court has said that the Delhi Special Police Establishment Act, which requires the state government's permission for CBI for powers and jurisdiction. These provisions conform to the federal character of the Constitution. Recently the Uddhav Thackeray government of Maharashtra had issued an order and said that the permission given to the CBI to conduct an investigation in the state is withdrawn.

However, with the withdrawal of permission from the Maharashtra government, there will be no impact on the ongoing investigation. But if the CBI wants to investigate a new case in Maharashtra in future, it will need to get permission from the state government, unless an inquiry has been ordered by the court.
