SC orders Rs 20 lakh compensation to former judicial officer

New Delhi: Taking a historic decision, the Supreme Court has given a huge amount to a former officer as compensation. The Supreme Court granted this compensation to the officer who got compulsory retirement due to allegations of corruption, when the allegations were false. The Supreme Court noted that the Gujarat High Court had ruled that no allegations of corruption were made against the former judicial officer.

A bench of Justices Deepak Gupta and Anirudh Bose, however, did not agree with the High Court's view that since the 53-year-old officer has been away from the job for eight years, he cannot be brought back into service after so long. The bench said in its judgment, "Once the High Court has ruled that the charges against the appellant (judicial officer) have not been proved, he should be brought back to service keeping in mind his honor and dignity."

We provide that the appellant (officer) did not do anything which does not suit the judicial officer. The court ruled that he could not be brought back into service as he had already crossed the retirement age. Therefore they will be given a lump sum according to their salary.
