During the hearing, Judge SA Bobde asked the petitioner whether you were prevented from going to the mosque. So the petitioner said that yes. Then the court asked that in which mosque women are allowed to enter? Then the petitioner had said that in Macca. Then Justice Bobde asked if the right to equality can be used against any person? Can Section 14 be used for this? Are there temples, mosques or church states? Then the petitioner said that these are not states, but they take all the facilities from the state. Then the court said that we are hearing your petition only on the basis of the decision of the Sabarimala temple.
The petition, filed through advocate Ashutosh Dubey, said that prohibiting the entry of women into mosques is a violation of sections 14, 15, 21, 25 and 29 of the Constitution. The Constitution of India gives women the right to equality. Therefore, not allowing women to enter mosques is a violation of that right.
