'Can't force anyone to take corona vaccine..', Supreme Court orders central government

New Delhi: The Supreme Court on Monday (May 2, 2022) made a significant observation on the vaccination programme being run by the government to protect against coronavirus infection. The Supreme Court has said that the government cannot force any person to get vaccinated. But she can make people aware of it. For this, the government can make a policy and impose certain conditions for the good of the people.

During this, the court also made it clear that as far as the existing vaccination policy is concerned, it cannot be said to be wrong. At the same time, the court also said that as long as the number of COVID-19 cases is less, people who are not vaccinated in the public areas should not be banned and if there is any such order, it should be withdrawn. On Monday, a bench of Justices L Nageswara Rao and BR Gavai ruled that the court was not willing to interfere with the vaccine. The scope of judicial review is limited in the policy decision of the government on the opinion of experts.

The court also said that the government can make the general public aware for the benefit of the people, and impose restrictions for the prevention of the disease, but it cannot force it to get vaccinated and take any kind of special medicine. The Supreme Court has also asked the central government to make public the data on the adverse effects of corona vaccination. However, the court has termed the Centre's vaccination policy as rational. The apex court has directed the government to provide the data of all tests conducted under the privacy of the people and all the tests to be conducted later on to the public with regard to the separation of vaccine testing data, and all tests to be conducted later, to be made available to the public immediately.  

The apex court has also directed the Central government to publish reports on cases of adverse effects of vaccines on the public and doctors on a publicly accessible system without compromising on private data of individuals. The court has asked the government to make public the report of adverse events regarding the vaccine. For this, data should be collected through a system of public access from the general public and doctors. At the same time, the data of the person should also be protected. The court gave the verdict on a petition filed by Jacob Puliyal.
