New Delhi: These days there are frequent reports of conflicts between doctors and governments in the country. Many of the cases reach the court door. Doctors are protesting against the bonds that they pay at the time of admission to Para Graduate and Super Specialty Courses. In this connection, they approached the apex court. They termed this binding bond as a violation of fundamental rights. The Association of Medical Super Specialty Institute and Residents had filed a petition in this regard.

That was rejected by the court. The court said the bond was correct and they would have to abide by them. The Supreme Court said that the state government can use its powers to ask doctors to provide compulsory service. The court said it is not a violation of fundamental rights. A bench of justices L. Nageshwar Rao and Hemant Gupta, in view of the widespread public interest and benefits to the Mahroom community from medical care, has rightly held that various state governments have imposed public service bonds for one to five years after completing the course. Or is.

There is also a provision of a fine of Rs.10 to 50 lakh for those who do not comply with the bond. The Bench has upheld such bonds that have been dumped by other States including Himachal Pradesh, Andhra Pradesh, Goa, Gujarat, Karnataka, Kerala, Maharashtra, Odisha, West Bengal, Rajasthan. In its order, the apex court said that doctors seeking stipend services for short term work cannot complain that they are engaged as bonded labourers. The court said that doctors cannot call for bonded labour in any manner to provide services in government hospitals. There is a very bad medical condition in the rural circles of the country.
