INX Media case: Now ED can also arrest Chidambaram, SC dismissed anticipatory bail plea

New Delhi: Former Finance Minister P Chidambaram has received a major setback from the top court in the ED case related to INX Media rigging. A division bench of Justice Bhanumathi and Justice Bopanna has rejected Chidambaram's anticipatory bail plea. With the anticipatory bail petition dismissed, the ED can now arrest Chidambaram.

Earlier, Solicitor General Tushar Mehta, appearing for the ED in the top court, opposed Chidambaram's anticipatory bail, saying that if Chidambaram is granted anticipatory bail, it will have disastrous consequences. He said that this is because it will have a direct impact on cases like Vijay Mallya, Mehul Choksi, Nirav Modi, Sharda Chit Fund, Terror Funding.

Tushar Mehta, opposing the demand for arrest inquiry without showing evidence, said that how the investigation is done, the agency decides it responsibly. To show evidence to the accused who is roaming free is to give an invitation to erase the remaining evidence.

Tushar Mehta said that how to carry forward the investigation, it is completely the right of the agency. From the point of view of the matter, the agency decides at which stage the evidence should be revealed and which is not. If all the evidence, witnesses will be placed before the accused before the arrest, then it will be like giving the accused an opportunity to tamper with the evidence and end the money trail.
