Supreme court rejects Mamata Banerjee's govt 'West Bengal housing industries regulation act 2017'

New Delhi: Mamata Banerjee has been sworn in as the third consecutive West Bengal CM on Wednesday. Earlier, the Supreme court gave a major blow to the Bengal government. The Supreme Court struck down the West Bengal Housing Industries Regulation Act, 2017 (WBHIRA). A bench headed by Justice DY Chandrachud of the Supreme court gave the verdict on Tuesday.

The Bengal government had enacted the law in place of the Central Government's Real Estate (Regulation and Development) Act, 2016 (RERA). Terming the state government's law as unconstitutional, the court said attempts to establish parallel governance cannot be accepted. The Supreme Court further said that if there is a central government law on a subject, the state government cannot enact the same kind of law. According to a bar and bench report, the court said, "West Bengal has tried to establish a parallel regime which is not constitutionally acceptable. ”

According to media reports, the Supreme court has termed the state government's law as an encroachment on central law and said that the law created a parallel system and interfered with the jurisdiction of Parliament. The court said that in such a situation, the law of the state government cannot exist and is quashed.
