Another blow to Anil Deshmukh, SC rejects Maharashtra govt's plea

New Delhi: The Supreme Court on Wednesday rejected a Maharashtra government's plea urging the FIR filed by the CBI against former state home minister Anil Deshmukh to remove two paragraphs relating to transfer, deployment, and restoration of a police officer. A bench of Justices DY Chandrachud and MR Shah said it does not want to interfere in the July 22 order of the Bombay High Court. With this, the court dismissed the petition.

The Supreme Court said it cannot reduce the Constitutional Court's order to conduct an inquiry by the Central Bureau of Investigation (CBI) by deciding on the aspects on which the inquiry will be conducted. The court said, CBI has to look into all aspects of the charges and we cannot limit them. It is like rejecting the forces of the Constitutional Court. The bench said that an impression is being created that the state police is trying to save the former Home Minister by not allowing an inquiry into the transfer and deployment of officers and restoration of Additional Inspector of Police Sachin Waje. Appearing for the Maharashtra government, advocate Rahul Chitnis said the state has withdrawn the consent given for the CBI probe, and the high court's direction for CBI investigation is limited to allegations of taking money from bars and restaurants and not transfer and deployment of police officers and restoration of Vaze in the police force.

The Bombay High Court had on July 22 said that the CBI may look into the transfer and deployment of police personnel in the Mumbai Police Force and restoration of Vaze to ascertain the connivance of former Maharashtra Home Minister Anil Deshmukh and his associates.
