A soldier who runs back from war are cowards: Supreme Court

NEW DELHI: The top court has rejected the plea of a sacked soldier who escaped during a terror attack in Jammu and Kashmir. During the 2006 attack, the soldier had fled from the scene of the counter-attack. The apex court also rejected the petitioner's plea that he had shown bravery in many such operations earlier. The apex court said that a soldier has an obligation to protect the country. He cannot rely only on the bravery shown in the past.

Rejecting the sacked soldier's plea, the Supreme Court said, "A soldier cannot live on the basis of his bravery shown in the past." In order to protect the integrity of the country, the soldier is expected to stand up in every situation because that is what the country believes in.

A bench of justices M R Shah and A S Bopanna delivered the verdict. The petitioner soldier was sentenced to life in prison under the Court Mortuary for running away from the war during the terror attack. He was also sentenced to six years rigorous imprisonment along with his dismissal.

The jawan had challenged the 2011 suspension decision of the Armed Forces Tribunal, Chandigarh in the SGCM. In 2006, the jawan had shown cowardice at the place of confronting terrorists in Jammu and Kashmir in an encounter with the counter-attack.

One of the jawans was martyred in the encounter with the terrorists. The sacked jawan was also found guilty of not using his weapons, AK-47 and pistols. The terrorists captured the check-posts and also grabbed the light machine gun due to lack of readiness by the jawan.
