Hindu Mahasabha advocates women's entry into mosques, SC says - it's not your case

New Delhi: A petition seeking a ban on the entry of Muslim women in mosques as illegal and unconstitutional has been dismissed by the apex court. Chief Justice Ranjan Gogoi has rejected the Hindu Mahasabha's plea saying that let a Muslim woman come to court on this demand first, then we will consider it.

The bench said that you have nothing to do with it, before the apex court has accepted the petition of the Muslim couple from Maharashtra on the permission of prayers in the mosque. In fact, the Hindu Mahasabha had challenged the Kerala High Court's decision in the apex court which rejected the demand. The petition had sought the Supreme Court to issue a detailed directive in this regard. The petition said that the ban on the entry of Muslim women into mosques is a violation of their fundamental rights.

In August 2016, the Bombay High Court had ordered the removal of the ban on women going to the Mazar of Mumbai-based famous Haji Ali Dargah on a similar petition. The High Court then held that the ban on women's entry was a violation of their fundamental rights enshrined in the Constitution. However, the High Court judgement was also challenged in the apex court on behalf of the Dargah Trust. However, the top court had also upheld the High Court ruling. It was the first time women had entered the interiors of the famous Haji Ali dargah.
