'Motive was to separate Kashmir from India..,' court framed charges against 15 accused

New Delhi: A Delhi court has taken major action against Jammu and Kashmir Liberation Front (JKLF) chief Mohammad Yasin Malik in a 2017 terror and separatist activities case. The court framed charges under the Unlawful Activities Prevention Act (UAPA) against 15 people, including Yasin Malik. Special court judge Justice Parveen Singh, who is hearing the case, termed it a "well-planned conspiracy."

According to Justice Singh, the masterminds of this conspiracy were the people of ISI sitting in Pakistan across the border. Each of the conspirators was acting on the instructions of the mastermind and their ultimate goal was to isolate Kashmir by causing bloodshed, violence, devastation and destruction. The court observed that there were large-scale protests initially as part of a larger criminal conspiracy, which led to incidents of violence. The court also said that the conspiracy of violence was hatched to achieve the basic goal of separating Kashmir from India.

Along with this, the court found that Yasin Malik played an important role in promoting terrorism in the Valley. In view of this, the court framed charges under UAPA against Yasin Malik and those involved in it. The court said, 'It has been argued that these people were protesting peacefully in Gandhian manner. Whereas, prima facie evidence says otherwise. The protests were not only violent but were also intended to be violent. In this way, their plan was as direct and clear as the march of Brownshirts, the real army of Adolf Hitler and the Nazi Party. Their motive was nothing less than to intimidate the government and plan any rebellion.

The Hurriyat Conference had conspired with terrorist organizations to fulfil its objective. The terrorists against whom charges have been framed by the court are Hafiz Muhammad Saeed, Mohammad Yusuf Shah, Aftab Ahmed Shah, Altaf Ahmed Shah, Naeem Khan, Farooq Ahmed Dar, Raja Mehrajuddin Kalwal, Bashir Ahmed Bhat, Zahoor Ahmed Shah Watali, Shabbir Ahmed. Shah, Masrat Alam, Abdul Rashid Sheikh and Naval Kishore Kapoor.
