New Delhi: The Supreme Court has quashed the one-year suspension of 12 Bharatiya Janata Party (BJP) MLAs from the Maharashtra Legislative Assembly, terming it as unconstitutional. Let us tell you that on July 6 last year, the MLAs were suspended for one year for abusing and misbehaving with the Speaker in the Assembly.

Now the Supreme Court has said in its decision that suspension of more than one session is not in the power of the House and it is unconstitutional to do so. Justice AM Khanwilkar said that suspending MLAs for one year is worse than expulsion and will amount to punishment to the entire constituency. He said that, 'No one can represent these constituencies in the house, because only the MLA of the area will not be present in the house. It is tantamount to punishing the entire constituency, not the member.

The Supreme Court further said that it will conduct a judicial review of the one-year suspension sentence. However, the Maharashtra government has sought time to file a reply. A bench of Justice AM Khanwilkar and Justice Dinesh Maheshwari is hearing the matter.
