Mumbai: Hearing has been completed in the Supreme Court on the plea given by the Uddhav faction regarding the Nabam Rebia decision on the disqualification of Shiv Sena rebel MLAs (Shinde faction) in Maharashtra. Today i.e. on Thursday (February 16), the constitution bench of 5 judges has reserved the decision in this matter. The top court will first decide whether to refer the matter to a 7-judge constitution bench or a 5-judge constitution bench.
As per reports, the Supreme Court has reserved judgment on a constitution bench seeking a review of the 2016 Arunachal Pradesh Nabam Rebia judgment. The top court will first determine whether to refer Nabam Rebia to a larger bench for reconsideration. Earlier, the Supreme Court had said on Wednesday (February 15) that some changes are needed in Nabam Rebia's decision. The Supreme Court had said that we will not say that the 2016 decision was wrong, but there is a need to strengthen it by making some changes.
In fact, during the hearing, the Uddhav faction had also raised questions on some aspects of the Nabam Rebia verdict, demanding that the matter be sent to 7 judges to hear some aspects of it. At the same time, the Shinde faction said that there is no need to reconsider the Nabam Rebia verdict. In the Nabam Rebia case of Arunachal Pradesh, a 5-judge constitutional bench of the Supreme Court had said that it cannot decide on the disqualification of legislators if a petition for the removal of the Speaker is already pending.
