New Delhi: With the formation of the Law Commission, the issue of the Uniform Civil Code (UCC) has again come into the limelight. The 22nd Law Commission, headed by Justice Rituraj Awasthi, will have to expedite the report on the UCC issue, pending since the time of the previous Law Commission, as the matter is sub-judice in the apex court. Where the government had said that it would proceed only after receiving the report of the commission. The tenure of the 21st Law Commission came to an end in August 2018 with the issue of a consultation paper on UCC.

After this, the petitions regarding UCC in the Supreme Court are waiting for disposal. Seeking to dismiss them, the Ministry of Law and Justice has told the court in an affidavit that whenever the report of the Law Commission will be received in this matter. The government will investigate the matter in consultation with all the stakeholders involved. In such a situation, it is being told that the retired Chief Justice of Karnataka High Court, Justice Awasthi, who gave the verdict on the hijab case, will soon submit a report on the UCC to the government. Whereas the 22nd Commission will soon have to prepare a report on the law on conversion, preventing infiltration in the country, uniform education policy, and population control.

Ashwani Upadhyay, the petitioner in the top court on the issue of the increasing population from UCC, says that petitions on 4 issues have been in the apex court for two-three years, while the issue of uniform education policy is in the Delhi High Court since 2020. In the next hearing, he will demand to send everyone to the Law Commission. Upadhyay says that the commission's report will bring clarity to the current requirements and the government will also have to act quickly.
