USA: Rules regarding H1-B visa gets stringent; know details

Changes have been made in H1-B visa rules by the USA. President Donald Trump’s government on Tuesday revealed stringent rules for immigration visas used widely by technology firms, asserting that the new system would be more beneficial for American workers. The Department of Homeland Security declared the new set of laws for so-called H-1B visas that remain reserved for highly skilled workers, which allow up to 85,000 immigrants annually. The step signaled a new move directed at making the immigration quite strict under the Trump presidency, which attempted to block the H-1B program in a move that ended last week by a federal judge.

On Tuesday, new regulations and details were discussed. They were not disclosed, would narrow the definition of “specialty occupation” which according to DHS “allowed companies to game the system.” The plan, to be executed after a 60-day comment period, would also attempt to require firms to make “real” offers to US residents before endeavoring to bring in immigrants and add new agreement mechanisms. The visa program has been extensively used by Silicon Valley firms to bring in engineers and other skilled workers, many coming from the country of India. Critics have said the program has depressed salaries in some professions.

“We have entered an era in which economic security is an integral part of homeland security,” acting Homeland Security Secretary Chad Wolf announced in a statement. He further added, “Put simply, economic security is homeland security. In response, we must do everything we can within the bounds of the law to make sure the American worker is put first.” Last week, US District Judge Jeffrey White in San Francisco granted a preceding injunction to hinder the government from ending the H-1B visa program, in a case brought by the US Chamber of Commerce and supported by technology trade groups.
